1. Scope & Acceptance

These Terms of Service ("Terms") govern your access to and use of SimRacingJobs.com (the "Platform"), operated by Appgineering GbR ("we", "us", or "our"). By accessing or using the Platform, you agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must not use the Platform.

These Terms apply to all visitors, registered users, job posters, applicants, and organization administrators. Additional terms may apply to specific features or services, in which case they will be presented to you before you use those features.

2. Eligibility

You must be at least 16 years of age to create an account and use the Platform. By registering for an account, you represent and warrant that you meet this age requirement.

If you are between 16 and 18 years of age, you represent that you have obtained the consent of your parent or legal guardian to use the Platform and agree to these Terms. We reserve the right to request proof of age or parental consent at any time.

3. Account

User authentication on SimRacingJobs.com is handled through Appgineering OAuth, our centralized authentication service. By creating an account, you agree to the terms of the Appgineering authentication service in addition to these Terms.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security.

We reserve the right to suspend or terminate your account at any time if we reasonably believe that you have violated these Terms, or if your account poses a security risk to the Platform or other users.

4. Platform Description

SimRacingJobs.com is a free job board designed to connect talent with opportunities in the sim racing industry. The Platform allows users to browse and post job listings, create talent profiles, apply for positions, manage organizations, and communicate with other users.

The Platform is provided free of charge. We reserve the right to introduce paid features or services in the future, in which case you will be notified in advance and given the choice to opt in.

5. User Content

You retain ownership of all content you submit, post, or display on or through the Platform ("User Content"), including but not limited to job listings, profile information, portfolio items, and messages.

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, display, and distribute your User Content solely for the purpose of operating and providing the Platform. This license ends when you delete your User Content or your account, except where your content has been shared with others and they have not deleted it.

You represent and warrant that you own or have the necessary rights to submit your User Content, and that your User Content does not infringe upon the rights of any third party.

6. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

Spamming: Sending unsolicited messages, posting repetitive or irrelevant content, or using the Platform for mass distribution of commercial messages.

Fake Listings: Posting fraudulent, misleading, or deceptive job listings or talent profiles, including listings for positions that do not exist or misrepresent the nature of the work.

Harassment: Engaging in behavior that is threatening, abusive, harassing, defamatory, or otherwise objectionable toward other users.

Scraping: Using automated tools, bots, or scripts to access, scrape, or collect data from the Platform without our explicit written permission.

Impersonation: Pretending to be another person or entity, or falsely claiming an affiliation with any person or organization.

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this provision, including removing content, suspending or terminating accounts, and reporting violations to law enforcement authorities.

7. Job Listings & Applications

The Platform serves as a venue for connecting job posters with applicants. We do not guarantee the accuracy, completeness, or reliability of any job listing or application submitted through the Platform.

SimRacingJobs.com is not a party to any employment agreement, contract, or arrangement between users. We do not act as an employer, employment agency, or recruiter. Any employment relationship formed through the Platform is solely between the job poster and the applicant.

We do not verify the identity, qualifications, or background of any user, and we make no representations or warranties regarding any user or their content. You are solely responsible for conducting your own due diligence before entering into any employment or contractual arrangement.

8. Organizations

The Platform allows users to create and manage organizations, such as sim racing teams, leagues, or broadcasting groups. Organization owners are fully responsible for all content posted on behalf of their organization, including job listings, descriptions, and media.

Organization owners and administrators are responsible for managing their members and ensuring that all members comply with these Terms. Any violations committed by organization members may result in consequences for the organization as a whole, including suspension or removal.

We reserve the right to remove or suspend any organization that violates these Terms or that we reasonably believe is being used for fraudulent or harmful purposes.

9. Intellectual Property

The Platform, including its name "SimRacingJobs.com", logo, design, user interface, graphics, and all associated intellectual property, is owned by Appgineering GbR and is protected by applicable intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Platform, nor may you reverse engineer or attempt to extract the source code of the Platform, unless expressly permitted by law or with our written consent.

All trademarks, service marks, and trade names displayed on the Platform are the property of their respective owners.

10. Disclaimers

The Platform is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Platform will be uninterrupted, timely, secure, or error-free. We do not warrant that the results obtained from the use of the Platform will be accurate or reliable.

Any content downloaded from or otherwise obtained through the use of the Platform is accessed at your own discretion and risk, and you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such content.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Appgineering GbR, its members, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of the Platform.

In accordance with German law (Haftungsbeschränkung), our liability for damages caused by slight negligence is excluded, except in cases of injury to life, body, or health, or the breach of essential contractual obligations (Kardinalpflichten). In such cases, our liability is limited to foreseeable, typically occurring damages.

Our liability for damages caused by intentional misconduct or gross negligence remains unlimited as required by law.

12. Termination

Either party may terminate this agreement at any time. You may terminate your account by using the account deletion feature available in your account settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

We may suspend or terminate your account at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violations of these Terms, extended periods of inactivity, or requests by law enforcement.

Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions.

For consumers within the European Union, mandatory consumer protection laws of your country of residence shall apply to the extent they provide a higher level of protection.

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts competent for the registered seat of Appgineering GbR, unless mandatory statutory provisions dictate otherwise.

14. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you via email or through the Platform.

Your continued use of the Platform after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform and delete your account.

We encourage you to review these Terms periodically to stay informed of any updates.
